Chris Weigant: The Individual Mandate's Conservative Origins

For the past three days, the political world has been largely focused on the Supreme Court, and the arguments over whether President Obama's signature legislative achievement is constitutional or not. At the heart of the argument is the "individual mandate," a section of the law which would require Americans to pay more money on their income taxes if they could afford health insurance but chose not to purchase it from a private company.

In the 2008 presidential election campaign, Barack Obama disagreed with Hillary Clinton on this issue. Clinton was for the individual mandate, Obama was not. Once he got elected and started wheeling and dealing with the insurance industry, however, Obama agreed to include the individual mandate in the law now universally known as "Obamacare."

While we're all waiting for the verdict from the Supreme Court, I thought it would be worthwhile to dig into the actual origins of the concept of the individual mandate. Now, the idea itself may have been around for much longer than the documentation I could find online, but the real political push behind the idea seems to have started in 1989, from the ultra-conservative Heritage Foundation.

Stuart M. Butler, who at the time was Heritage's Director of Domestic Policy Strategies, wrote the second chapter of a position paper with the title "A National Health System for America." (Heritage has a PDF version of this document you can download from their website.) The document was over 100 pages long, and envisioned a "consumer-oriented, market-based, comprehensive American health system" that would become "the model for the entire industrialized world." It was a strictly conservative plan, as evidenced by the inclusion of the idea of replacing Medicare with a voucher system (the same thing Paul Ryan is now championing, in other words).

In his chapter "A Framework for Reform," Butler lists three elements which would be required to remold the American health care system into his conservative vision for the future. The very first of these, in full (chapters referenced are from the same document):

Element #1: Every resident of the U.S. must, by law, be enrolled in an adequate health care plan to cover major health care costs.

This requirement would imply a compact between the U.S. government and its citizens: in return for the government's accepting an obligation to devise a market-based system guaranteeing access to care and protecting all families from financial distress due to the cost of an illness, each individual must agree to obtain a minimum level of protection. This means that, while government would take on the obligation to find ways of guaranteeing care for those Americans unable to obtain protection in the market, perhaps because of chronic health problems or lack of income, Americans with sufficient means would no longer be able to be "free riders" on society by avoiding sensible health insurance expenditures and relying on others to pay for care in an emergency or in retirement.

Under this arrangement, all households would be required to protect themselves from major medical costs by purchasing health insurance or enrolling in a prepaid health plan. The degree of financial protection can be debated, but the principle of mandatory family protection is central to a universal health care system in America.

Help would be provided in two ways. First, the tax code would be amended, as Chapter 3 describes, to give tax relief to individual purchasers of health insurance or prepaid plans and to provide tax credits for out-of-pocket expenses. Second, government would aid those who, because of income or medical condition, find the cost of protection to be an unreasonable burden. Such aid could take the form of vouchers for purchasing insurance or state-managed systems as described in Chapter 5.

The requirement to obtain basic insurance would have to be enforced. The easiest way to monitor compliance might be for households to furnish proof of insurance when they file their tax returns. If a family were to cancel its insurance, the insurer would be required to notify the government. If the family did not enroll in another plan before the first insurance coverage lapsed and did not provide evidence of financial problems, a fine might be imposed.

In the mid-1990s, of course, the Democrats attempted health care reform. The most famous of these attempts was Hillary Clinton's, but many other Democrats also proposed plans of their own in Congress. By 1994, Butler (now listed as "Vice President and Director of Domestic Policy Studies" at Heritage) wrote a critique of the individual mandate included in one of these Democratic bills, although it's interesting to note that he doesn't seem to be against the concept itself, rather choosing to complain about the projected costs to families of the plan. Constitutional questions aren't even raised.

By 2003, congressional Democrats had failed in their health reform efforts (and Obama's election was still five years in the future), so it was safe once again for conservatives to back the individual mandate. At this point in time, Butler's title at Heritage was "Vice President of Domestic and Economic Policy Studies," and he was testifying before the Senate Special Committee on Aging. Here, however, he specifically points out at the beginning of his testimony that the views he is expressing are his own and not the official position of the Heritage Foundation. During his testimony, Butler gives even more detail on how he sees the individual mandate working:

The current social contract should be replaced with a more rational one. In a civilized and rich country like the United States, it is reasonable for society to accept an obligation to ensure that all residents have affordable access to at least basic health care -- much as we accept the same obligation to assure a reasonable level of housing, education and nutrition.

But as part of that contract, it is also reasonable to expect residents of the society who can do so to contribute an appropriate amount to their own health care. This translates into a requirement on individuals to enroll themselves and their dependents in at least a basic health plan -- one that at the minimum should protect the rest of society from large and unexpected medical costs incurred by the family. And as any social contract, there would also be an obligation on society. To the extent that the family cannot reasonably afford reasonable basic coverage, the rest of society, via government, should take responsibility for financing that minimum coverage.

The obligations on individuals does not have to be a "hard" mandate, in the sense that failure to obtain coverage would be illegal. It could be a "soft" mandate, meaning that failure to obtain coverage could result in the loss of tax benefits and other government entitlements. In addition, if federal tax benefits or other assistance accompanied the requirement, states and localities could receive the value of the assistance forgone by the person failing to obtain coverage, in order to compensate providers who deliver services to the uninsured family.

The individual mandate which was included in Obamacare is so close to what Stuart Butler of the Heritage Foundation initially suggested that we can honestly say there is no appreciable difference between the two. The only real difference is whether Republicans supported the idea or not. When it was branded as a conservative idea from a conservative think tank, then Republicans embraced the idea as requiring "personal responsibility" from all those deadbeats out there who were getting a free ride on the taxpayer's dime. These were the days when "reforming welfare" was a big deal, and Republicans tended to lump a lot of things under the dreaded "welfare" label, to give some rhetorical context.

But when Democrats agreed to the idea -- in the 1990s, and then later when Obamacare was being debated -- Republicans decried the idea and refused to support it (to put all their histrionics and hyperventilating over Obamacare's mandate in the mildest terms I can manage). That, it seems, is really the only thing which has changed over time. The idea itself hasn't changed in any appreciable way from what was proposed in 1989. Republicans' support of the idea, however, waxes and wanes depending on who proposes it.

Well, to be fair, I should say "those Republicans who are not named Mitt Romney," as Mitt is truly in a class by himself when it comes to supporting... and then not supporting... the idea of the individual mandate. But that's a subject for an entirely different blog post.

This blog is based upon an editorial written in the March 20, edition of USA Today. The editorial is entitled ?States Battle Voting Fraud with Epidemic of New Limits? and it?s opposing view: ?In Texas, Evidence of Voter Fraud Abounds?

Two articles debate election laws and question whether we should allow a state to put ID requirements in place at the voting stations.

The USA Today editorial is in support of NOT requiring ID as a means to protect against voter fraud. ?Greg Abbott, Texas attorney General, opposes this and defends why Texas has put in a voter ID requirement to minimize voter fraud.?It is interesting that both sides recognize the prevalence of fraud, and acknowledge fraud to be a problem in the voting system.

The?question is: How do we balance the actions needed to prevent fraud?

The USA Today Editor says ?individual rights transcend the protection of fraud?. In other words, if a person might be prevented from voting due to the inconvenience of getting an ID, then we should allow everybody to vote without ID?s.

Philosophically, this is the ?one versus many.? So the many can vote but the one might suffer because they couldn?t get around to getting an ID. ?The Texas?Attorney?General feels if a person wants to vote, they can get an ID. This doesn?t cost them money, it?s not inconvenient, we make it possible. He believes this is a matter of individual responsibility embedded in the right to vote.

As a matter of business, fraud is real and must be prevented. Collective individual responsibility goes out the window because the full responsibility for protecting against fraud is put solely on the particular business in question. ?See the difference?

It is modern social thinking that has allowed us to come up with this notion that people are not necessarily responsible and therefore can?t burdened with individual responsibility. In business you don?t have that option. The reality of the marketplace is that if you don?t stay focused on the disciplines of the individual responsibility and doing everything that it takes to protect against fraud, the marketplace will crush you. It?s an important business ethics discussion because we have to recognize that the standards in community have more bandwidth than the market allows us to have in business.

Telenav opens up Scout for Apps, the HTML5 GPS navigation service, to all interested devs

At the end of last year, Telenav revealed its browser-based HTML5 turn-by-turn navigation system and made it available to a select few devs to put it to good use. For an encore, it unveiled its personalized GPS service, Scout, at CES. Now, the company has created Scout for Apps and made the service available to all developers who want it, assuming they're coding iOS or HTML5 applications (Android support is in the works, and is slated to arrive later this year). That means that apps and websites can now incorporate turn-by-turn navigation directly, as opposed to launching a separate application to get you where you want to go. Keep in mind that Telenav isn't pitching this as a full GPS replacement -- more a value added proposition to developers -- and after spending some time using Scout, we can see why.

We tested the browser-based Scout service on our Android handset to run a few errands, and we found it a useful tool, but it certainly pales in comparison to its application counterparts. There's noticeable lag when attempting to swipe around maps, no pinch to zoom (onscreen buttons are the only option), and it lacks features like traffic reports or a way to remember favorite locations. That said, it does do a good job of getting you where you want to go, and the rudimentary nav functionality is certainly more appealing than the static maps found in apps currently. Plus, it's quite nice to not have to launch a separate application to get directions. Let?s keep the answer simple; everything that is related to your health.

The most important indicators for your state of health can be measured though your vital signs, like blood pressure, cholesterol level, heart beat, body mass index etc. The major input that influence these health indicators are what and how much you eat and drink, smoke, medication use, life style, daily activity and air quality.

Beside our genetic disposition, we are what we eat, drink and breathe.

A good health and fitness software program should be able to capture the above mentioned input and correlate the results with the output, or health indicators. This way you create a cause and effect system that the user can analyze and consequently take corrective measures and improve his or her overall health.

The bigger picture teaches us that an effective health and fitness software program contains modules that can monitor our food intake, record our body measurements and vital signs. Furthermore it should track our daily activities and convert them into calories burned. Also it should keep track of our medicine and supplement intake and monitor our overall health level. For the sport and bodybuilders we need additional modules that can keep track of our workout activities, sport results and fitness tests

Let?s start with food intake.

Most of the time we eat together with our family therefore a health and fitness software program should never be restricted to one user.

People tend to repeat the recipes they cook and meals they prepare on a regular interval. For most people this interval is between 20 and 30 days. Furthermore people tend to buy more or less the same ingredients for their meals. For this reason a fitness or diet program boosting databases with thousands of food items will be more of a hindrance than a benefit. The reason that I say this is because it will be very time consuming to pick an ingredient for a recipe or meal plan from a list of thousands of ingredients.

Look for a program that has the basic ingredients to build your recipes and allows you to add food items that are specific to your taste.

A food?s nutrition facts change depending on how it is conserved, processed or cooked. For example a cup of canned spinach that is cooked will have totally different nutrition facts than a cup of fresh spinach. Look for a program that can make a distinction between these food properties.

The cost of buying special diet foods can be a lot more (up to 2.5 times) than what the average American spends on food. It is a plus if a health and fitness software program can keep track of the food cost by recipe, meal and day. It is really a bonus if the program can compare grocery prices between shops and help you budget.

A recipe module is imperative to a good health and fitness system. This is the place where you can experiment and adjust your recipes to your diet?s nutritional fact limits. The recipe should calculate its nutritional facts per portion depending on the weight ratio of each ingredient that has been added to the recipe. Naturally you should be able to print the recipe and see the total recipe cost and the cost per portion. Having the ability of adding recipe pictures is a plus.

You should also have the ability to create multiple meal plans in the system. Maybe you would like a separate plan for the kids or baby. Or for a partner that has a cholesterol problem, high blood pressure or diabetes. Or you simply want to change diets. These meal plans should repeat over a certain amount of days. The timing of the meals should be more then just breakfast, lunch and dinner. Many diets ask for many small recipe portions during the day. The food items that you select on the meal plan should come from the ingredients as well as from the recipes. For instance you can add a raw apple to your meal plan, which is an ingredient to make an apple sauce recipe. The apple sauce recipe or the raw apple can each be added to the meal plan

As you would expect, the software program should be able to calculate the meal plan cost and nutrition facts by day and for the whole meal plan.

How are you going to keep track of what you actually ate on a particular day and how do you know how to stick exactly to your plan? You do this by printing a meal plan worksheet for a particular day and you note the actual differences from the plan.

We don?t have much time in today?s busy society; therefore you should be able to register the actual daily food consumption in less then 30 seconds. A system that forces you every day for every meal to select your food items from a list of thousands records is not going to make it in 30 seconds. Only select a system that automatically populates your meal plan for that day and you only update the actual differences from the plan.

Just adding your daily food intake to a database is not going to benefit you. It will create a ?data cemetery?, data that is never examined. The food data needs to be analyzed and correlated to other types of data like your body measurements or calories burned. Click on the calorie analysis hyperlink to view an example. The chart makes it very quickly clear that the calorie intake line is under the calories spent line and consequently you will lose weight.
